The Indonesian Ministry of MSMEs has issued Ministerial Regulation No. 3 of 2026 to strengthen the protection and competitiveness of micro and small enterprises (MSMEs) operating on e-commerce platforms. The regulation requires platforms to establish fair, transparent, and clearly defined partnership agreements, including detailed disclosure of all fees charged to MSMEs—covering amounts, calculation methods, and payment procedures. Any changes to fees must be mutually agreed upon, with platforms obligated to provide at least 90 days’ notice before implementation. MSMEs are also given the right to raise objections and seek negotiation facilitation through the SAPA UMKM platform, ensuring greater certainty and protection against sudden or unilateral cost increases. In addition to regulatory protection, the policy introduces incentives to enhance the competitiveness of local products. E-commerce platforms are required to provide a minimum 50% service fee discount for verified MSMEs selling domestic products, helping them maintain profitability amid growing competition, particularly from imported goods. The regulation includes a transition period of up to six months for implementation, though the government aims to accelerate system readiness and data integration.
