INDONESIA’S NEW INVESTMENT REGULATION TO ACCELERATE LICENSING PROCESS

Indonesia has significantly streamlined its investment licensing process with the introduction of Government Regulation No. 28 of 2025, replacing the earlier Regulation No. 5 of 2021. Minister of Investment and Downstream Industry and Head of the Investment Coordinating Board (BKPM), Rosan Roeslani, emphasized that the new regulation empowers the Ministry of Investment and Downstream Industry to automatically issue permits if other ministries fail to respond within the set deadlines, addressing past inefficiencies where approvals were delayed for months. This reform is expected to enhance legal certainty and investor confidence, especially as it introduces a Service Level Agreement (SLA) framework that enforces strict timelines for each stage of the licensing process. The regulation also introduces a fictitious-positive policy, allowing the system to advance licensing steps automatically if deadlines are missed, and simplifies procedures for micro and small enterprises (UMK) through a self-declaration model via the upgraded Online Single Submission (OSS) system. The OSS now includes subsystems for Basic Requirements, Business Facilities, and Partnerships. Furthermore, the government has declared PP No. 28/2025 as the sole authoritative reference for business licensing, prohibiting any additional requirements from other agencies unless explicitly stated in the regulation.
