AGRICULTURE MINISTRY SEEKS FEEDBACK ON 2024 LAND LAW REVISIONS

A major concern is the complexity caused by the requirement for annual district-level land use plans, which has increased administrative procedures and delayed land access. Although the law permits the use of existing urban and rural planning documents in place of land use plans, the coverage of such planning remains low across many localities. As a result, overlapping plans are still required, causing inefficiencies and wasted resources. The ministry also noted the absence of legal provisions for land recovery in projects with specific location requirements or in urgent political or diplomatic cases, such as APEC-related developments or projects within free trade zones and international centres. Regarding land pricing, the ministry proposed that the State take direct control as the landowner, abandoning the market-based approach. Instead, pricing methods would serve only as references, while the State sets the official land prices. Two options for pricing revisions were presented: (1) issuing a land price list every five years based on specific zones and locations, or (2) reinstating the land price adjustment coefficient (K coefficient) to annually adjust the five-year base prices.
